Hereinafter also referred to as “Akasha Luxury“, “Seller” or “Owner“.

Subject

These General Conditions govern the online sale of products marketed through the website www.akashaluxury.com.

The purchase of products implies full knowledge and acceptance of these conditions by the buyer.

These conditions apply exclusively to consumers and users who make purchases through the site.

Description of the activity

Akasha Luxury was born from Silvia Scudeletti’s vision to create works and furnishings that enhance spaces through balance, beauty, and quality.

The collections include, but are not limited to:

symbolic terracotta works of art;
harmonic plates;
home accessories;
handcrafted ceramic sinks;
designer air fresheners;
Limited Edition collections;
additional furnishing and design elements.

Each creation is designed to integrate harmoniously into domestic and professional environments.

Scope of application

These Terms govern all purchases made through the Site.

Any different conditions will only be effective if expressly agreed in writing.

Product

The information, descriptions, and photographs on the site are intended to represent the products as faithfully as possible.

However:

photographs;
colours;
texture;
finishes;
proportions;

may present slight differences compared to the actual product depending on the device used by the user.

Such differences do not constitute a lack of conformity.

Consulting services

In addition to selling physical products, Akasha Luxury offers professional consulting services aimed at analyzing, enhancing, and realigning living and professional spaces.

Consultations available on the site include, but are not limited to:

ESSENCE
DIRECTION
EVOLUTION

Each program is described on its own page on the website, which lists its contents, number of sessions, implementation methods, objectives, and fee.

Consultations are provided by appointment agreed upon between the parties, according to the methods communicated to the Customer after confirmation of purchase.

Meeting dates can be agreed upon based on the Client’s and Professional’s availability.

Artisanal nature of the products

Akasha Luxury products are handcrafted.

For this reason, each item has its own characteristics that make it unique.

There may be slight differences regarding:

shades;
nuances;
texture;
veins;
finish;
dimensions;
small aesthetic details.

These characteristics represent the natural result of craftsmanship and do not constitute defects or flaws in the product.

However, each creation maintains the quality standards expected of the Akasha Luxury brand.

Product Availability

The availability indicated on the website is updated periodically.

In exceptional cases, unavailability may arise due to:

simultaneous purchases;
technical errors;
production problems;
force majeure.

In such circumstances the customer will be promptly informed and will be able to choose whether to:

wait for new availability;
receive a full refund;
agree on an alternative solution.

Price

All prices published on the site are expressed in Euros (€).

Prices include VAT where applicable according to current legislation.

Shipping costs are automatically calculated during checkout before confirming your order.

Akasha Luxury reserves the right to change prices at any time.

The changes will not affect orders already confirmed.

Purchase procedure

To purchase a product the customer must:

select the desired product;
add it to the cart;
enter the required data;
choose the available shipping method;
select the payment method;
check your order summary;
definitively confirm the purchase.

Sending the order constitutes a contractual purchase proposal.

The contract is considered concluded only with the sending of the order confirmation by Akasha Luxury.

Payment Methods

The customer can make the payment by:

Stripe
PayPal
Klarna
Bank transfer

Transactions are processed through secure payment platforms.

Akasha Luxury does not directly store or process payment card data.

For payments made by bank transfer, the order will be processed after the amount has been credited to the indicated bank account.

Billing

If the customer wishes to receive an invoice, they must communicate this during the purchase phase, providing all the required tax information.

Once the invoice has been issued, it will no longer be possible to modify its data.

Shipping

Akasha Luxury ships to:

throughout Italy;
in the countries of the European Union;
in the main non-EU countries.

Shipments are entrusted, depending on the destination and type of order, to specialized couriers such as:

Mail Boxes Etc.
DHL
UPS
GLS
BRT

The courier is selected by the Seller based on the destination, the size of the package and logistical needs.

Delivery times are indicative and may vary due to causes beyond the Seller’s control.

Any delays attributable to the courier, weather events, strikes, customs checks, or force majeure do not entitle you to cancel your order or request compensation.

International shipping

For shipments to countries outside the European Union, the following may apply:

customs duties;
local taxes;

These costs are the sole responsibility of the recipient and are not included in the price of the products or in the shipping costs indicated during checkout.

The customer is required to check in advance any customs requirements in their country.

Checking the goods upon delivery

Upon delivery, the Customer is required to verify that:

the packaging is intact;
the number of packages corresponds to that indicated in the transport documents;
there are no obvious signs of damage.

If the package shows visible anomalies, the Customer is invited to accept the delivery with specific reservations, indicating the reason directly on the courier’s document.

Any damage that is not immediately visible must be reported to Akasha Luxury within 48 hours of delivery by sending a communication to the email address

support@akashaluxury.com, attaching detailed photographs of the product, packaging, and shipping label.

Right of withdrawal

Pursuant to Articles 52 et seq. of Legislative Decree 206/2005 (Consumer Code), the consumer Customer has the right to withdraw from the contract within 14 (fourteen) days of receiving the products, without having to indicate the reason.

To exercise the right of withdrawal, simply send a written communication to the address:

indicating:

order number;
name and surname;
contact details;
products for which you intend to exercise the right of withdrawal.

Right of withdrawal for consultancy services

The consumer customer has the right to exercise the right of withdrawal within 14 days of purchasing the service, provided that the execution of the consultancy has not yet begun.

If the Customer expressly requests that the service be performed before the withdrawal period expires, he/she agrees that the right of withdrawal will be governed by the applicable legislation.

If the service has been fully performed with the Customer’s express consent before the withdrawal period expires, the Customer will no longer be able to exercise the right of withdrawal, pursuant to art. 59 of Legislative Decree. 206/2005.

If the Client cancels a scheduled consultation, they are required to notify us at least 48 hours in advance. Otherwise, Akasha Luxury reserves the right to consider the session as having been regularly performed, unless otherwise determined based on the circumstances of the case.

Return conditions

To be eligible for a refund, the product must be returned:

whole;
unused;
complete with all accessories;
in the original packaging, where possible;
properly packaged.

Akasha Luxury reserves the right to verify the condition of the products before proceeding with the refund.

If the product is damaged due to improper use or insufficient packaging during return transport, a reduction in the refundable amount may be applied, within the limits permitted by applicable law.

Return costs

The costs related to returning the products are borne by Akasha Luxury.

After receiving the withdrawal request, the Seller will communicate to the Customer the operating procedures for returning the goods and, where applicable, will arrange for collection by a designated courier.

Reimbursement

Once the returned products have been received and inspected, Akasha Luxury will refund the amount within the timeframe established by applicable law and, in any case, within 14 days of receiving the notice of withdrawal, without prejudice to the right to withhold the refund until the goods have been received or proof of shipment has been provided.

The refund will be made using, where possible, the same payment method chosen by the Customer at the time of purchase.

Legal guarantee of conformity

All products sold through the site are covered by the Legal Guarantee of Conformity provided for by Articles 128 et seq. of the Consumer Code.

The warranty lasts 24 months from delivery of the goods to consumers.

The guarantee covers exclusively defects of conformity existing at the time of delivery.

The following are excluded from the warranty:

accidental damage;
normal wear and tear;
improper use;
improper maintenance;
damage resulting from impacts, falls or interventions carried out by the Customer or third parties.

Characteristics of artisanal products

Akasha Luxury creations are made using predominantly artisanal processes.

Each product represents a unique piece or a creation with its own distinctive characteristics.

Any differences relating to:

color;
nuances;
porosity;
texture;
slight irregularities;
small dimensional variations;

They are to be considered typical characteristics of artisanal workmanship and testify to the authenticity of the product.

These peculiarities do not constitute defects or grounds for complaint.

Intellectual property

All content on the site, including, but not limited to:

brands;
logos;
photographs;
Images;
artistic works;
texts;
descriptions;
video;
graphic elements;
design;
layout;
symbols;
collections;

are the exclusive property of Akasha Luxury or their respective rights holders.

Any reproduction, copying, distribution, modification, publication or use, even partial, is prohibited without the prior written authorization of the Owner.

Use of the site

The user undertakes to use the site in compliance with current legislation and the principles of fairness and good faith.

It is prohibited to use the site for illicit, fraudulent purposes or purposes that compromise the proper functioning of the platform.

Akasha Luxury reserves the right to limit or terminate access to the site in the event of behavior contrary to these conditions.

Limitation of liability

Akasha Luxury cannot be held responsible for:

delays attributable to couriers;
force majeure events;
internet service interruptions;

temporary unavailability of the site;
errors resulting from improper use of the products;
indirect or consequential damages arising from the use of the site or the products purchased.

The Seller’s liability remains governed by the mandatory legislation applicable to consumer protection.

Privacy

Personal data is processed in compliance with Regulation (EU) 2016/679 (GDPR) and applicable national legislation.

The methods of data collection, use, and storage are described in the Privacy Policy, available on the website.

Cookie

The site uses technical cookies and, with the user’s consent where required, analytical, functional, and marketing cookies.

Information on the cookies used is available in the Cookie Policy published on the site.

The user can change his/her preferences at any time via the dedicated Cookie Preference Center.

Changes to these Terms

Akasha Luxury reserves the right to modify these General Conditions at any time.

The changes will take effect from the date of their publication on the site and will apply exclusively to orders placed after that date.

Applicable law

These General Conditions are governed by Italian law.

For anything not expressly provided for, the provisions of the Civil Code, the Consumer Code, and the current legislation on electronic commerce apply.

Dispute Resolution

Consumers residing in the European Union may use, where available, the alternative dispute resolution (ADR) tools provided for by current legislation.

The right to appeal to the competent judicial authority remains unaffected.

Competent court

For any dispute relating to the application, interpretation or execution of these General Conditions, if the Customer is a consumer, the Court of the place of residence or domicile of the consumer will have jurisdiction, pursuant to the legislation in force.

In all other cases, the Court of Bergamo will have exclusive jurisdiction.
